Two FDCPA Lawsuits Filed Against Alltran Financial in the Same Day

A proposed class action out of California claims Grand Celebration Cruises invaded consumers' privacy by placing unsolicited calls to consumers' cell phones.
Alltran Financial, LP, which formerly went by the name United Recovery Systems, L.P., is the defendant in two proposed class action lawsuits filed on the same day by separate plaintiffs who claim the company committed violations of the Fair Debt Collection Practices Act (FDCPA). Each plaintiff alleges they were sent collection notices by the defendant that were likely to be misconstrued by the least sophisticated consumer due to Alltran’s alleged failure to disclose the individuals’ balances may increase due to interest and/or fees. Although the plaintiffs’ balances were in fact increasing with accruing interest (due to the original creditors’ contracts), the defendant allegedly violated the FDCPA by failing to disclose this in its notices as required. As a result of such conduct, the case posits, the least sophisticated consumer may be unsure whether paying the “current amount due” will satisfy a debt in full and clear his or her account.
