Two Suffolk County, New York consumers claim in a proposed class action that EGS Financial Care, Inc. sent collection notices that failed to comply with the FDCPA.
Two Suffolk County, New York consumers claim in a proposed class action that EGS Financial Care, Inc. sent collection notices that failed to comply with the Fair Debt Collection Practices Act (FDCPA). According the lawsuit, EGS Financial Care failed to state whether the plaintiffs’ respective balances would be accruing interest and/or late fees, thereby muddying the waters for the plaintiffs when trying to determine how much would need to be paid to fully resolve their individual debts. The case further claims the notices in question unlawfully fail to advise on other items, including any minimum amount that could be paid at any time.
