Two plaintiffs have sued Forster & Garbus claiming they received collection notices that failed to clearly and concisely state the amount of debt owed.
Forster & Garbus, LLP is facing a proposed class action brought by two plaintiffs who say they received from the company collection letters that neglected to clearly and concisely convey the amount of debt from the perspective of the “least sophisticated consumer.” Claiming violations of the Fair Debt Collection Practices Act (FDCPA), the lawsuit argues the defendant’s letters failed to provide the plaintiffs with information necessary to deduce the minimum amount of payment owed at the time the notices were received, as well as the applicable interest rate, date of accrual of interest, and a breakdown of the principal, interest and late fees connected to the respective debts. Adding to the plaintiffs’ apparent confusion as to how much debt they each truly owed is the defendant’s statement that their balances may increase due to the accrual of interest, the suit claims.
“For these reasons,” the complaint reads, “the letters would likely make the least sophisticated consumer confused as to the amount of debt.”
