Aguirre v. Vivint Solar Developer, LLC
Filed: September 4, 2017 ◆§ 1:17-at-00665
Vivint Solar, SolarCity and American Array Solar are facing separate lawsuits claiming they used English-language contracts to deceive Spanish-speaking consumers in CA.
California
Two California law firms have filed three separate proposed class actions against solar power entities Vivint Solar Developer, LLC, SolarCity Corporation and American Array Solar, Inc. that allege the companies violated state law by brandishing “misleading representations” about the quality of (and savings associated with) their products by requiring non-English-speaking consumers to sign English-language contracts. Citing alleged violations of the California Translation Act and other consumer protection statues, the lawsuits each claim the defendants solicited proposed class members, who the cases say solely speak Spanish, in person to drum up business. The negotiations between proposed class members and the defendants, during which the cases say it was represented to the individuals that they energy bills would decrease should they switch to solar, were reportedly conducted in Spanish, the suits continue. The plaintiffs allege this is the part in the conversation where the defendants’ negotiating tactics changed. From the lawsuits (emphasis ours):
