A proposed class action alleges the Truffettes de France made by Chocmod USA and OverSeas Food Trading Ltd. are falsely and misleadingly labeled given that the truffles are not made in and imported from France but instead come from Canada.
The 20-page lawsuit says that the product, whose name in French translates to “truffles from France,” is mislabeled such that reasonable consumers have paid a premium that they would not have been willing to pay had they known the chocolate was not actually made in and imported from France.

As the case tells it, the product’s name is “an unequivocal representation that the chocolate truffles are made in and imported from France.” Other label statements, including “Depuis 1948,” reinforce that the truffles are made in France, the filing says.
“While some of Chocmod’s other chocolate products are made in France, the Product challenged here is manufactured in and imported from Canada,” the lawsuit states. “As such, the labeling of the Product is false and deceptive.”
According to the complaint, numerous consumers have taken to the truffles’ Amazon product page to complain about being “deceived” by the defendants’ packaging. Nevertheless, the defendants “deceptively advertise” the truffles so as to capitalize on consumer demand for authentic French-made sweets, the lawsuit alleges.
“Plaintiff and other consumers would have paid significantly less for the Product, or would not have purchased it at all, had they known the truth about it,” the suit reads.
The lawsuit looks to cover consumers nationwide who bought Truffettes de France within the applicable statute of limitations period.
