Alabama
Fleetmatics and Verizon Connect Fleet USA, LLC are facing a lawsuit filed by five trucking companies that claim the defendants breached their contracts with the plaintiffs and failed to provide the promised services.
According to the lawsuit, Congress passed the MAP-21 bill in 2012, which, among other mandates, required truck drivers to track their hours of service through electronic logging devices (ELDs) instead of paper logbooks. In order to comply with the new bill by its December 2017 deadline, the plaintiffs allegedly contracted with the defendants to install ELDs in their trucks and provide “timely, proper and adequate training, customer service, monitoring and maintenance of the ELD units.”
The lawsuit claims the defendants failed to provide the promised services, forcing the plaintiffs to enter into contracts with other companies to become compliant with the new standards before the deadline. Nevertheless, the case continues, the defendants continued to charge the plaintiffs the agreed-upon monthly payments in accordance with their contracts despite failing to provide the contracted services in exchange.
