An Illinois consumer has filed suit against Western Express, Inc. over allegations that the company failed to provide him with proper disclosures in accordance with the Fair Credit Reporting Act. The plaintiff says he applied for a commercial truck driver position with the defendant and was denied employment after the company conducted a background report on him through a third-party consumer reporting agency. The suit argues that Western Express unlawfully denied the plaintiff his right to fair employment by failing to inform him that he was rejected based on information found in his consumer report and provide him with the information he needed to dispute any inaccurate information in the report, including the contact information for the consumer reporting agency.
