A class action has been filed in Atlanta against Tropical Smoothie Café over the smoothie chain's use of contaminated strawberries.
A class action has been filed in Atlanta against Tropical Smoothie Café over the smoothie chain’s use of contaminated strawberries alleged to be responsible for numerous illnesses across dozens of states. Court documents detail that “at least 100 people in seven states … have been sickened in a [hepatitis] outbreak” that has been linked to frozen strawberries sourced from Egypt.
The suit seeks to cover two subclasses: an “exposure” class of individuals who consumed smoothies containing the allegedly contaminated strawberries who were exposed to hepatitis; and an “injury” class of individuals who were actually infected and diagnosed with hepatitis after consuming smoothies containing the affected strawberries. Both classes combined, the suit says, essentially cover all individuals who ate or drank anything at any of the 500 Tropical Smoothie Café locations between January and August 2016, regardless of whether they became sick, so long as they underwent treatment and/or incurred medical bills.
