According to an online notice posted by Trionfo, an unauthorized party gained access to the tech company’s computer systems between December 4 and December 6, 2023, exposing private information belonging to its “business customers’ employees or their customers’ employees.”
The 45-page Trionfo data breach lawsuit says the incident compromised victims’ names, addresses, dates of birth, Social Security numbers, telephone numbers and/or email addresses, and has exposed them to a lifetime risk of fraud.
“[The plaintiff] and class members must now and in the future closely monitor their financial accounts to guard against identity theft,” the suit stresses. “[The plaintiff] and class members may also incur out of pocket costs for, for example, purchasing credit monitoring services, credit freezes, credit reports, or other protective measures to deter and detect identity theft.”
The Trionfo Solutions data breach lawsuit claims the cyberattack stemmed from the defendant’s failure to implement adequate data security measures. Per the filing, Trionfo, an insurance technology solutions company, could have prevented the data breach by adequately encrypting the private information in its care, or detected the intrusion sooner by properly monitoring its computer network.
“By acquiring and utilizing and benefiting from the [personally identifiable information] for its business purposes, Trionfo owed or otherwise assumed common law, contractual, and statutory duties that extended to [the plaintiff] and class members,” the case reads. “These duties required Trionfo to design and implement adequate data security systems to protect [the plaintiff’s] and class members’ [personally identifiable information] in its possession and to keep the information confidential, safe, secure and protected from unauthorized disclosure, access, dissemination or theft.”
The suit notes that Trionfo waited until around January 9, 2024 to send notice of the breach to its business customers, including co-defendant Gallagher Benefit Services, Inc. Affected individuals did not learn of the incident until around May 22, 2024, when Trionfo sent a notice letter that the lawsuit says omitted several critical facts about the cyberattack, the filing relays.
The lawsuit looks to represent anyone in the United States whose personal information was maintained on Trionfo’s computer systems that were compromised in the data breach, including those who were sent email notices of the incident from the company.
