According to the 35-page data breach lawsuit, the insurance company experienced a “data security incident” in which certain “backup tapes” containing private information went missing sometime between July 7 and July 10, 2023. Per the suit, the backup tapes were stored in a lockbox at a TUIC office that was in the process of being moved to a different location.
The case relays that the personal data exposed in the breach varies by individual but may have included names, Social Security numbers, dates of birth, driver’s license numbers, government- or state-issued ID numbers, financial account and payment card numbers, passport details, and medical treatment and/or health insurance information.
As the complaint tells it, the insurance company stored the sensitive information “in a reckless manner” and failed to properly safeguard and monitor it.
In addition, although the lockbox purportedly disappeared in July of last year, TUIC did not notify data breach victims until mid-February 2024, the filing points out.
The plaintiff, a TUIC customer from Texas, received notice on February 15 of this year informing him that his personal data had been compromised in the breach, the suit says. Like other victims, the man now faces an ongoing threat of identity theft and fraud as a result of the defendant’s negligent conduct, the case claims.
The complaint contends that the defendant’s failure to notify affected individuals until six months after the lockbox went missing has “exacerbate[d] the circumstances for victims,” for whom a prompt warning was vital to mitigate the consequences of the incident.
The lawsuit looks to represent anyone Trinity Universal Insurance Company has identified as being among the individuals impacted by the data breach, including those who were sent notice of the incident.
