Trident Asset Management LLC is on the receiving end of a proposed class action lawsuit filed by a New York man who claims the defendant denied his right to dispute a debt.
Trident Asset Management LLC is on the receiving end of a proposed class action lawsuit filed by a New York man who claims the defendant denied his right to dispute a debt. The plaintiff says he called the debt collector and informed its representative that he intended to dispute the debt he allegedly owed. The defendant’s employee, according to the complaint, informed the plaintiff that "saying you're disputing it, doesn't do anything" and that he must state a reason for the dispute and submit it in writing.
The suit argues that the Fair Debt Collection Practices Act allows consumers to orally dispute debts without a stated reason and that the defendant’s requirements, therefore, violated the law.
