A proposed class action was filed in California last month against Total Merchant Services, Inc. over allegations that it placed illegal telemarketing calls to consumers’ cell phones.

A proposed class action was filed in California last month against Total Merchant Services, Inc. over allegations that it placed illegal telemarketing calls to consumers’ cell phones. The plaintiff says he received a call on June 16, 2017 with a prerecorded voice that attempted to sell him credit card processing services. According to the suit, the plaintiff “has never been a customer of Total Merchant Services, nor has he ever been interested in being a customer of Total Merchant Services.”
The complaint claims the call, which the plaintiff allegedly never consented to receive, was “an annoying, harassing nuisance” and even worse, was placed in violation of the Telephone Consumer Protection Act (TCPA).
