Total Card, Inc. and Cavalry SPV I, LLC are the defendants in a lawsuit that alleges the companies misrepresented a consumer’s time-barred debt.

Total Card, Inc. and Cavalry SPV I, LLC are the defendants in a lawsuit that alleges the companies misrepresented a consumer’s time-barred debt.
The suit takes issue with a May 2017 letter sent to the plaintiff that allegedly stated, in part:
“The law limits how long you can be sued on a debt. Because of the age of your debt, Cavalry SPV I, LLC will not sue you for it…”
The case argues that the statement falsely implied the defendants have chosen not to sue the woman, when, in fact, the statute of limitations on the debt had expired and no party was legally permitted to sue the plaintiff over the obligation.
The suit further claims the letter was deceptive because it failed to disclose that any payment made on the account would restart the statute of limitations.
