Tomy B Haircare Inc. is on the receiving end of a proposed class action lawsuit filed by a disabled woman who claims she was unable to access the defendant’s haircutting salon.
Tomy B Haircare Inc. is on the receiving end of a proposed class action lawsuit filed by a disabled woman who claims she was unable to access the defendant’s haircutting salon. The plaintiff, who the complaint says must use a scooter for mobility, alleges that the defendant’s establishment is within three miles of her house, but that she was deterred from visiting the site due to several access barriers, including the following:
- the route to the entrance from accessible parking spots, streets, and sidewalks is inaccessible;
- the entrance walkway has “unlawful changes in level”;
- the entrance door lacks maneuvering clearance;
- the bathroom is inaccessible;
- the lavatories and sinks in the bathroom are inaccessible; and
- the faucets in the bathroom cannot be operated with one hand.
According to the suit, the defendant has failed to maintain compliance with the Americans with Disabilities Act (ADA) and several state civil rights laws. The plaintiff claims accessibility modifications to the defendant’s site are “readily achievable” and that she intends to return there once the changes have been made.
