Three Flecks, You’re Out: NY Debt Collector Fleck, Fleck & Fleck Hit with FDCPA Lawsuit

Fleck, Fleck & Fleck is the defendant in a case that claims it violated federal debt collection laws.
From New York comes a proposed class action case in which a consumer claims Fleck, Fleck & Fleck mailed him a collection notice that left him unable to determine how much he would need to pay to satisfy his debt at any given moment in the future. Though the notice in question did state the plaintiff’s balance of $1,506.34, the complaint says Fleck, Fleck & Fleck unlawfully failed to disclose:
- The applicable interest rate;
- The date of accrual of interest;
- What part of the balance stated is attributable to principal;
- What part of the balance stated is attributable to interest; and
- What part of the balance stated is attributable to late fees and other costs.
The case rounds out by arguing the defendant left the plaintiff unable to determine the true amount of debt owed.
