Lifetime Kia, Parkway Automotive Group, Inc., and Blueridge Automotive Group, Inc. are named in a proposed class action wherein the plaintiff company claims it received unsolicited fax advertisements from the defendants in violation of the TCPA.
Lifetime Kia, Parkway Automotive Group, Inc., and Blueridge Automotive Group, Inc. are named in a proposed class action wherein the plaintiff company claims it received unsolicited fax advertisements from the defendants in violation of the Telephone Consumer Protection Act (TCPA). The plaintiff alleges the defendants have recently sent out thousands of unwanted fax messages that did not contain TCPA-required opt-out language, leaving recipients with little recourse to avoid receiving the advertisements in the future. From the complaint:
[The defendants’] facsimile encourages readers to ‘Register…to gain access to thousands of units!’ and then provides a website address to do so. [The plaintiff] never registered for such information. Indeed, prior to receiving the above alleged facsimile, [the plaintiff] had never heard of [the defendants] nor visited their websites. [The plaintiff] certainly did not have an established business relationship as defined within the terms of the TCPA.”
