The Brooklyn Botanical Garden is on the receiving end of a proposed class action filed by a blind individual who claims she is unable to access the garden's website.
The Brooklyn Botanical Garden is on the receiving end of a proposed class action lawsuit filed by a blind individual who claims she is unable to access the garden’s website using her screen reader. The lawsuit alleges that the website, www.bbg.org, excludes the blind population from “full and equal participation” in the goods and services it offers, including ticket sales. The plaintiff says she intends to use the site once various access barriers are removed, including the inaccessible forms, the lack of navigation links, and the inability to navigate the site using a keyboard instead of a mouse.
The suit seeks monetary damages for proposed class members and injunctive relief against the defendant, requiring it to comply with state and federal law and allow the blind population to “independently and privately use” its website.
