The Moore Law Group is facing a lawsuit that alleges the firm attempted to “mislead, deceive and scare” a consumer with a “threatening” collection letter.

The Moore Law Group is facing a California consumer’s proposed class action in which she alleges the firm attempted to “mislead, deceive and scare” her with a “threatening” collection letter.
The plaintiff claims she received the letter in January 2018 regarding an obligation owed to Capital One Bank. According to the case, the letter stated:
“It is our office’s intention to file a lawsuit to collect the balance owing on the above referenced account.”
Upon receiving the letter, the plaintiff supposedly believed that “a lawsuit would be imminent” should she fail to make a timely payment. The suit claims, however, that the firm unlawfully threatened to take action it did not truly intend to take. From the complaint:
“As of October 16, 2018, over nine months after the January 03, 2018 was sent, Defendant has yet to file a lawsuit against the Plaintiff regarding the alleged debt.
As evidenced by the lack of communications by the Defendant to the Plaintiff since January 3, 2018, Defendant at the time the letter was sent did not intend to sue the Plaintiff.”
