The Melting Pot Operating Co. Facing TCPA Lawsuit
Last Updated on May 8, 2018
Maxwell v. Cohn Restaurant Group, Inc.
Filed: August 9, 2017 ◆§ 3:17-cv-01609-JLS-BGS
Cohn Restaurant Group, the company behind The Melting Pop, is facing allegations it illegally sent unwanted text messages.
California
A California man alleges in a proposed class action that Cohn Restaurant Group, Inc., which does business as The Melting Pot, violated the Telephone Consumer Protection Act (TCPA) when it sent text messages to his cell phone without first receiving prior express consent to do so. The plaintiff claims the defendant obtained his cell phone number after he called their San Diego, California location to book a reservation. According to the plaintiff, at no time during his conversation with the defendant's receptionist was he provided with an explanation as to why his cell phone number was needed. The plaintiff then says he received a text from the defendant on the evening of his reservation informing him that his table was ready. The case asserts the defendant used an automatic dialing system to send the unwanted texts.
