The Asset Recovery Group, LLC, which does business as The Judgment Group, is the defendant in a proposed class action that alleges it violated the FDCPA.
The Asset Recovery Group, LLC, which does business as The Judgment Group, is the defendant in a proposed class action that alleges it violated the Fair Debt Collection Practices Act (FDCPA) in the course of its communications with the plaintiff.
The lawsuit, which was filed in South Carolina district court, claims the Maryland-based defendant sent the plaintiff a collection notice that, in addition to failing to clearly identify the current creditor, was wrought with “false, deceptive and abusive language in violation of the FDCPA.” Specifically, the defendant allegedly illegally and falsely threatened the plaintiff, claiming it would “use criminal means to harm the reputation of the plaintiff” and advertised that it would tell others of the plaintiff’s debt.
