A Florida consumer claims The Gap and Old Navy sent marketing text messages to her cell phone using automated technology without consent.
A Florida woman has filed a proposed class action lawsuit against The Gap, Inc. and Old Navy, LLC over the companies’ alleged practices of sending marketing text messages advertising various deals and discounts to consumers without first obtaining express written consent to do so. The plaintiff charges the texts are sent using mass-automated, third-party technology in violation of the Telephone Consumer Protection Act (TCPA).
The plaintiff claims she began receiving at least one text per week from the defendants in October 2016.
