A consumer claims the Container Store sent automatically generated text messages without first obtaining express written consent to do so.
The Container Store faces a proposed class action case filed in Florida over alleged violations of the Telephone Consumer Protection Act (TCPA).
The plaintiff claims the retailer unlawfully used automatic dialing technology to send him at least one marketing text message to promote a spring sale. According to the suit, the plaintiff never expressly consented in writing to be contacted by the Container Store via auto-dialer before he received the text. The TCPA, the lawsuit says, mandates that companies obtain “prior express written consent” before communicating with a consumer’s cell phone.
