Temsa North America is among the defendants in a lawsuit filed by a transportation company that alleges the Turkish coach bus manufacturer’s vehicles are stricken with “significant mechanical and electrical defects.” Filed in California, the proposed class action claims the defendants’ buses are highly unreliable for service, and that the plaintiff’s customers outright refuse to ride in the vehicles due to the supposedly obvious defects, which include “significant vibration” during operation.
“This has severely impacted [the plaintiff’s] ability to conduct its business,” the complaint states.
The vehicle at the center of the lawsuit is the defendants’ TS45 motor coach, of which the lawsuit says hundreds have been made and distributed throughout the United States. These motor coaches supposedly suffer from a common manufacturing and design defect that the plaintiff alleges manifested itself immediately after purchase. The suit claims that despite the plaintiff taking its TS45 bus for repairs on roughly six occasions, the vehicle remains defective while continuing to diminish in value due to “out-of-pocket costs such as repair invoices and related hotel/taxi charges.”
According to the lawsuit, the defendants knew or should have known of the supposed defects before releasing the TS45 into the market. Moreover, the plaintiff argues that as the buses are defective to the extent that the defendants simply cannot fix them, the company and proposed class members have been forced to stop using the TS45 and similarly made buses in their fleets.
In addition to Temsa North America, the lawsuit names as defendants Temsa Global Sanayi Ve Ticaret A.S.; Temsa Ulasim Araclari Sanayi Ve Ticaret A.S.; Temsa Europe NV; and Haci Omer Sabanci Holding A.S.
