According to the lawsuit, the defendant sent the plaintiff a collection letter that stated the agency was “conducting a balance verification audit to verify the accounts receivable balances for” the woman’s creditor. The notice allegedly directed the plaintiff to “verify that the amount shown above is correct” by signing the bottom of the letter and mailing it to the defendant’s address.
The case argues that the defendant’s directions overshadowed the included disclosure concerning the plaintiff’s right to dispute the debt within 30 days of receiving the letter.
“Plaintiff was left unsure as to whether she had to write and mail the Defendant if she disputed the account balance as instructed in the letter, or whether she can do so by phone,” the complaint reads.
