TD Bank USA, N.A. is on the receiving end of a proposed class action lawsuit that alleges the bank illegally records calls made to consumers’ cell phones. The plaintiff, a California resident, claims the defendant called him to discuss the collection of a debt – which the suit notes is private and “highly personal” – and was not informed at the start of the conversation that the call would be recorded. According to the complaint, the man was “shocked” upon discovering the defendant’s alleged “clandestine recording” and believes that the bank records all of its calls to consumers without their knowledge or consent.
