Nustarr, LLC (which does business as Apple Textbooks) and an individual with control of the business are facing a proposed class action lawsuit that claims the defendants sent thousands of unsolicited fax advertisements without the recipients’ prior consent. The faxes – which the complaint argues violated the Telephone Consumer Protection Act – allegedly did not include required opt-out notices containing information on how to avoid receiving future faxes.
