A proposed class action alleges Vimo, Inc.—which does business as GetInsured.com—violated the Telephone Consumer Protection Act (TCPA) by placing an unsolicited telemarketing call to a consumer’s cell phone.
Filed in California, the suit alleges the defendant left a pre-recorded message on the plaintiff’s phone in July 2018 without first obtaining his express written consent to receive promotional calls. The plaintiff was never a client of the defendant’s services, nor did he ever provide his personal information to the company, the case adds.
Moreover, the suit charges the defendant “failed to properly scrub their telemarketing lead lists” to delete phone numbers registered with the National Do Not Call Registry, including the plaintiff’s cell phone number.
