A proposed class action citing alleged violations of the Telephone Consumer Protection Act (TCPA) has been filed against Pinecrest Bakery, LLC.
The plaintiff behind the suit claims the Miami bakery sent him two unsolicited text messages containing an advertisement and a coupon in July 2018. According to the case, the automated texts violated the TCPA because the defendant sent the messages using an automatic telephone dialing system without first obtaining the man’s express written consent to do so. Moreover, the complaint says the plaintiff’s phone number was on the National Do Not Call Registry when he received the supposedly illegal texts.
