A proposed class action claims defendant Data Software Services, LLC, which does business as Elead1One, willfully violated the Telephone Consumer Protection Act (TCPA). The 11-page lawsuit says the defendant, an automotive industry marketing company, contacted proposed class members’ cell phones by way of an automatic dialing system, the use of which is prohibited under the TCPA. The complaint says the calls utilized a robotic artificial or prerecorded voice message and were made without obtaining prior express consent from consumers.
