Emerchantbroker.com, LLC and First American Merchant Services, LLC are the defendants in a proposed class action over alleged violations of the Telephone Consumer Protection Act (TCPA). The plaintiff, a Virginia resident, reports being contacted by the defendants through an “automatic telephone dialing system” with the aim of soliciting his business. He claims that he did not provide prior consent to receive telemarketing calls from the defendants, and that the calls were an invasion of his privacy and left him “frustrated and distressed.” The lawsuit seeks injunctive relief and monetary relief of up to $1,500 per class member for each unwanted call.
