The Real Estate Empire Group, Inc. finds itself as the defendant in a proposed class action in which the plaintiff claims he received unsolicited text messages from the company in violation of the Telephone Consumer Protection Act (TCPA). Filed in Florida, the complaint alleges the Doral-based real estate brokerage firm “made the deliberate decision” to engage in mass text message marketing of both its business and the recruitment of real estate associates in the state by sending texts without first obtaining consent from recipients.
“Over the course of an extended period beginning no later than in 2018,” the case alleges, “[the defendant] and its agents directed the mass transmission of text messages to the cell phones of persons they hoped would potentially work as real estate agents for [the defendant].”
Per the plaintiff’s alleged experience, the case says the man received an unsolicited text message from the defendant in April 2018 that was sent by way of an automatic telephone dialing system.
