Viggiano v. Lakeshore Equipment Company
Filed: February 1, 2017 ◆§ 3:17-cv-00707-PGS-LHG
Lakeshore Equipment Company, which does business as Lakeshore Learning Materials, is facing a proposed class action lawsuit over alleged violations of the TCPA.
New Jersey
Lakeshore Equipment Company, which does business as Lakeshore Learning Materials, is facing a proposed class action lawsuit over alleged violations of the Telephone Consumer Protection Act (TCPA). The case claims the defendant sent millions of unwanted text messages to consumers after “purporting to designate the exclusive means by which consumers may withdraw consent to receive such messages.”
The plaintiff, a New Jersey woman, alleges she initially did give consent to the defendant to send her text messages, which are placed with an automatic telephone dialing system. Later, the case continues, the plaintiff withdrew her consent, yet still continued to receive the commercial texts from the defendants—even after demanding Lakeshore Learning Materials cease sending the texts.
