Alere, Inc. and Alere Home Monitoring have been hit with a class action lawsuit claiming the companies violated the Telephone Consumer Protection Act (TCPA).
Alere, Inc. and Alere Home Monitoring have been hit with a class action lawsuit claiming the companies violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited faxes. The junk faxes, which advertised the defendants’ warfarin monitoring program, the suit says, were sent without a notice allowing recipients to opt out of receiving future faxes. The proposed class includes anyone who received a unconsented promotional fax from the defendants that did not include a message on the first page that recipients can request to opt out of future messages.
