Tarte Hit with Class Action Over Allegedly Misleading ‘Natural’ Claims for Skincare, Makeup Products

Tarte faces a proposed class action over allegations that its skincare and makeup products are not all natural and contain a number of synthetic ingredients.
A proposed class action lawsuit out of New York alleges Tarte, Inc.’s advertising and marketing campaign for its “high-performance naturals” line of skincare and makeup products is misleading. According to the lawsuit, the products contain “a number of” synthetic ingredients, including:
- Citric acid;
- Butylene glycol;
- Cocamidopropyl Betaine;
- Tocopheryl acetate;
- Caprylyl glycol;
- Potassium sorbate;
- Sodium benzoate;
- Limonene;
- Polysorbate-20;
- Xylitol;
- Kaolin;
- Phenoxyethanol; and
- Glycerin.
The case asserts that a reasonable consumer would interpret the defendant’s marketing and advertising to mean its products contain no man-made ingredients.
“In making the false, misleading, and deceptive representations and omissions described herein, Defendant knew and intended that consumers would pay a premium for Products advertised as natural over comparable products not so advertised,” the suit reads.
