According to the 21-page Target lawsuit, the product was among several avocado oils that were found to be mixed with other oils after undergoing testing by scientists at the University of California at Davis. The complaint stresses that these test results contradict representations on product packaging that it is “100% Pure Avocado Oil.” Indeed, the class action suit points out that avocado oil is the sole ingredient listed on the back label.
Per the filing, consumers are willing to pay more for avocado oil over other types of cooking oils because it offers a variety of health benefits and has a high smoke point. In fact, the case notes, avocado oil can often command up to four times the price of its competitor, canola oil.
“But because avocado oil is more expensive to produce, some makers cut corners,” the complaint contends. “They substitute other oils, or mix avocado oil with cheaper seed oils.”
The suit says adulteration is a “pervasive” problem in the avocado oil industry, and any reasonable oil maker, seller or distributor would test its products for purity before placing them on the market. As the case tells it, Target is “aware of, willfully blind to, or negligent” regarding the fact that its avocado oil is impure and, therefore, misleadingly advertised.
Target’s alleged misrepresentations have caused consumers to pay more than they should have for the Good & Gather avocado oil, the complaint claims.
“If [Target] told the truth—that its oils are impure, and adulterated with other oils—the price of its avocado oil would drop dramatically,” the filing says. “If consumers knew the truth—that the product did not contain 100% pure avocado oil—they would not pay the current prices for the products.”
The Target lawsuit looks to represent anyone who purchased Good & Gather avocado oil within the applicable statute of limitations period.
