Tampa General Hospital Data Breach Lawsuit Settled for $6.8 Million

Tampa General Hospital has agreed to pay a $6.8 million settlement to resolve a class action over a May 2023 data breach that impacted approximately 2.1 million people.

The settlement covers anyone who was sent notice from Tampa General Hospital that their private information was potentially compromised as a result of the data security incident that occurred between May 12 and May 30, 2023.
The class action lawsuit alleged that the private hospital’s failure to implement proper cybersecurity measures resulted in the exposure of patient information, including names, addresses, phone numbers, dates of birth, Social Security numbers, health insurance information, medical record numbers, patient account numbers, dates of service and treatment information.

The Tampa General Hospital settlement, which received preliminary approval from the court in August 2024, will provide a variety of benefits to class members who file a valid claim form online or by mail by January 12, 2024.

To file a Tampa General Hospital settlement claim form online, head to this page. To fill out and submit a claim online, you will need the Unique ID and PIN found on the postcard settlement notice you should have received in the mail. If you did not receive a postcard notice or lost yours, contact the settlement administrator.
Class members can submit a claim form with supporting documentation to receive up to $1,500 in reimbursement for ordinary losses and up to $7,500 in reimbursement for extraordinary losses incurred as a result of the Tampa General Hospital data breach. Covered individuals are also eligible to receive reimbursement for up to four hours of lost time spent dealing with the breach at the rate of $25 per hour.
Alternatively, class members can elect to receive a $125 cash payment, which may increase or decrease on a pro-rata basis.
In addition to the foregoing settlement benefits, class members may submit a claim for three years of free credit monitoring services.
A final approval hearing for the Tampa General Hospital data breach settlement is set for February 3, 2025. It is typically after the court grants final approval to a class action settlement, and any appeals are resolved, that payouts and other settlement benefits begin to go out to eligible class members.
