An independent pharmacy in Tampa, Florida has filed a proposed class action alleging Fagron Holding USA, LLC and four subsidiaries sent junk fax messages in violation of the federal Telephone Consumer Protection Act (TCPA). The plaintiff alleges it received at least two faxes from the five defendants, one advertising a continuing education program offered by the companies, the other advertising pharmaceuticals. According to the case, both unwanted fax messages, which were allegedly received by at least 39 others, failed to include TCPA-mandated opt-out notices.
