Systems East, Inc. has agreed to settle a proposed class action lawsuit over a data breach that compromised the payment card information of 209,328 customers in August 2023.

The deal, which was preliminarily approved by the court in August 2024, covers anyone to whom Systems East sent notice of the security incident that it announced on or around November 16, 2023.

Class members have until November 15, 2024 to file a claim form for a Systems East settlement payout. You can submit a claim form online by heading to this page and entering the notice ID and confirmation code you received in your postcard settlement notice.
“If for some reason you did not receive this information, but believe you are a Settlement Class Member, please call 1-877-445-4011 or email info@systemseastsettlement.com to verify your identity and receive further information on how to file a claim,” the site says.
Covered consumers who submit a timely, valid claim form can request to receive either a $75 cash payment or up to $8,000 in reimbursement for out-of-pocket losses fairly traceable to the Systems East data breach. The $75 cash payment may increase or decrease on a pro-rata basis depending on how many valid claims are filed.
The court will decide whether to grant final approval to the settlement at a hearing set for December 4, 2024. Eligible class members will be issued cash payments after the deal receives final approval and any appeals are resolved.
The class action lawsuit against Systems East claimed the software company failed to take the proper steps to secure its computer network from unauthorized access, which allegedly allowed hackers to steal a database containing customers’ names and payment card information on August 25, 2023. According to the case, Systems East offers cloud-based collections and digital bill payment products, including Xpress-pay.
The defendant has agreed to implement and maintain improved cybersecurity measures as part of the settlement agreement.
