California
Systems & Services Technologies, Inc. is facing a proposed class action alleging it violated the Telephone Consumer Protection Act by placing autodialed calls to a consumer’s cell phone without his consent and despite his attorney’s cease and desist letters. According to the suit, the defendant was attempting to collect a debt purportedly owed by the plaintiff. The man’s attorney allegedly faxed and mailed two cease and desist letters to the debt collector on his behalf revoking any consent to receive autodialed or prerecorded calls to his cell phone. Nevertheless, the case claims, the defendant placed an illegal call to the plaintiff’s phone sometime after the letters were sent.
