Synergetic Communication, Inc. has been named as the defendant in a proposed class action lawsuit that claims it violated the Fair Debt Collection Practices Act (FDCPA) by misinforming a consumer of his right to dispute his alleged debt.
Synergetic Communication, Inc. has been named as the defendant in a proposed class action lawsuit that claims it violated the Fair Debt Collection Practices Act (FDCPA) by misinforming a consumer of his right to dispute his alleged debt. The plaintiff in the case claims he received a collection letter from the defendant that stated the following:
“To request substantiation of the debt please write to us describing the reason for your dispute. Include your name, address, the name of the creditor, and the account number listed on this letter and mail your request to us at [physical address].”
The suit claims that the defendant’s demand for a written dispute violates the FDCPA, which allegedly allows for both written and oral disputes.
