A blind individual has filed a proposed class action lawsuit against Sushirrito NYC 23rd, LLC and Sushirrito NYC BP, LLC claiming the companies’ website denies equal access to the visually impaired.

A blind individual has filed a proposed class action lawsuit against Sushirrito NYC 23rd, LLC and Sushirrito NYC BP, LLC claiming the companies’ website, www.sushirrito.com, denies equal access to the visually impaired. According to the suit, the defendants’ website provides information about Sushirrito restaurant locations and hours, a list of menu items, and the ability to order food for pick-up or delivery. The complaint specifically notes that the website is “heavily integrated” with the restaurants’ physical locations and “operates as a gateway thereto.”
The plaintiff says she is unable to access the restaurant’s website using screen reading technology because it contains various access barriers. In particular, the complaint argues that the site is lacking, among other back-end elements, alternative text that allows screen readers to identify graphics. Additionally, the site contains “empty links” that fail to specify their purpose and “redundant links” that hinder users’ ability to easily navigate the site, the suit says.
According to the complaint, the plaintiff was unable to visit the restaurants’ physical locations because she could not access this information on the website. She says she intends to travel to Sushirrito restaurants when the site becomes accessible to her.
