Sunset Pharmaceuticals Facing Lawsuit Over Alleged Junk Faxes

Orange County, California’s Retina Associates Medical Group has sued Sunset Pharmaceuticals, Inc. over alleged abuses of the Telephone Consumer Protection Act’s (TCPA) junk fax rules. The plaintiff claims it received an unsolicited advertisement fax in March 2018 that did not include proper notice detailing how to get out of receiving future faxes.

“On information and belief, [the defendant] faxes the same or other substantially similar facsimile advertisements to the members of the [proposed class] in California and throughout the United States without first obtaining the recipients’ prior express invitation or permission,” the complaint reads.
