Quiroz v. Beaverton Foods, Inc.
Filed: December 18, 2017 ◆§ 1:17cv7348
Beaverton Foods, Inc., the maker of Inglehoffer brand food products, is facing a lawsuit accusing it of mislabeling its 10 oz. Inglehoffer Original Stone Ground Mustard Sauce as having 'No Preservatives' despite containing citric acid.
Beaverton Foods, Inc., the maker of Inglehoffer brand food products, has been named as the defendant in a proposed class action lawsuit accusing it of mislabeling its 10 oz. Inglehoffer Original Stone Ground Mustard Sauce as having “No Preservatives” despite containing citric acid. According to the complaint, the U.S. Food and Drug Administration named the ingredient on its website as an example of a preservative and further confirmed its function in a warning letter to another food manufacturer regarding mislabeled products that allegedly contained “chemical preservative ascorbic acid and citric acid.”
The suit says the defendant “wrongfully capitalizes” on consumers’ desire for foods without preservatives by including the allegedly false claim on its mustard labels. The plaintiff argues that she would not have purchased the product, or would have paid less for it, had she known it contained a preservative.
