Franklin Collection Service, Inc. is facing a proposed class action lawsuit that claims it unlawfully requires alleged debtors to submit their disputes in writing. The plaintiff says he called the defendant to inquire about the debt it was attempting to collect and expressed his desire to dispute the amount. Franklin’s representative supposedly informed the plaintiff that he must submit his dispute in writing. The suit argues that the defendant’s demand for a written dispute violates the Fair Debt Collection Practices Act and that the law does not specify whether consumers must dispute debts in writing.
