Pomeroy IT Solutions Sales Company, Inc. is on the receiving end of a proposed class action claiming the company failed to meet certain disclosure and authorization requirements pertaining to its use of consumer background checks. The lawsuit, which cites possible Fair Credit Reporting Act (FCRA) abuses, claims the defendant procured consumer background reports for proposed class members without first disclosing in a standalone document that a background check may be obtained for employment purposes. Under the FCRA, the defendant procured class members’—Pomeroy employees and job applicants—background checks without proper authorization to do so, the lawsuit argues.
Specific to the plaintiff, the case claims the man, who applied for a Field Service Tech position with the defendant in 2016, was confused by the extraneous language allegedly contained in the company’s “Release Authorization and Notice and Disclosure” forms.
