The Law Office of Catherine Roselli is facing a proposed class action in which a Florida consumer claims the debt collector miscommunicated the amount of time he had to dispute his purported debt. In a collection letter sent on January 30, 2018, the defendant demanded payment of a medical debt supposedly owed to South Florida Pediatric Surgeons, P.A. and informed the plaintiff multiple times that he could dispute the debt within a 35-day window. The lawsuit argues that the validation period, as defined under the Fair Debt Collection Practices Act (FDCPA), is only 30 days. In fact, the case notes, the letter stated on the second page that the plaintiff had 30 days to dispute his debt, contradicting the information provided on the first page.
The suit argues that the defendant’s letter was “deceptive and false,” as it failed to accurately communicate the plaintiff’s FDCPA rights.
