Genpact Services LLC is the defendant in a proposed class action that alleges the company violated the Fair Debt Collection Practices Act by failing to clearly communicate the amount of a consumer’s purported debt. The plaintiff in the case says she received a collection letter from the defendant that stated the following:
“The total account balance as of the date of this letter is shown above. Your account balance may increase because of interest or other charges, if so provided in your agreement with your creditor.”
The suit argues that the letter failed to provide enough information for the plaintiff to determine the minimum amount she owed at any given time and the amount she would need to pay to resolve the debt. In particular, the complaint claims the defendant neglected to include the interest rate, date of accrual, nature of the “other charges,” and other information that would allow the plaintiff to calculate how much she truly owed.
