Kirschenbaum & Phillips, P.C. is facing claims that it violated the Fair Debt Collection Practices Act (FDCPA) by displaying a consumer’s private information in the window of a collection letter envelope. The plaintiff alleges she received an envelope from the defendant containing a glassine window through which her name and “Re: Creditor: DISCOVER BANK” was visible. The suit argues that under the FDCPA, debt collectors are not permitted to publicly display, as on an envelope, identifying information that associates a consumer with the debt collection process.
