Capital Management Services, L.P. is on the receiving end of a proposed class action lawsuit that takes issue with an allegedly misleading collection letter the defendant sent to a New York woman. According to the case, the letter contained an itemized list of charges – including the original amount due at charge-off, interest accrued, other fees, payments made, and the current amount due – but failed to indicate whether the balance was increasing. From the complaint:
“Defendant is aware that during the collection of this debt the balance may vary and not stating that it may increase is a deceptive collection tactic and an omission of a required disclosure to the consumer.”
