Simkhayev v. Arstrat, LLC
Filed: November 1, 2017 ◆§ 1:17-cv-06381
Arstrat, LLC is the defendant in a proposed class action lawsuit that accuses the debt collector of unlawfully requiring a consumer attempting to dispute a debt to provide a valid reason for the dispute.
Arstrat, LLC is the defendant in a proposed class action lawsuit that accuses the debt collector of unlawfully requiring a consumer attempting to dispute a debt to provide a valid reason for the dispute. According to the complaint, the plaintiff’s representative spoke over the phone with an employee of the defendant and was told that in order to dispute her purported debt, “she just needs to give us a reason why.” The suit argues that the Fair Debt Collection Practices Act does not require consumers to provide valid reasons or documentation in support of their disputes, and, according to the complaint, the defendant’s demand for validation was an unlawful attempt to discourage the plaintiff from exercising her FDCPA rights.
